OFCA Festival Regulations
REGULATIONS OF THE EVENT held under the name:
“Oleśnica’s Festival of Circus and Art”
In order to ensure the safety of the participants of the event, we hereby introduce these Regulations (hereinafter referred to as: the Regulations), worded as follows:

The Regulations, issued by the Organizer, i.e. by the “Fundacja OFCA” based at ul. Solarza 2B, 56-400 Oleśnica, KRS 559954, NIP 9112010907 (hereinafter referred to as: the Organizer), apply to the event under the name: Oleśnica’s Festival of Circus and Art which will be held from 11 to 13 August 2023 in Oleśnica (hereinafter referred to as: the Festival).
The purpose of the Regulations is to ensure the safety of participants of the Festival by defining the rules of behaviour of the persons present.

The Regulations are addressed to all the persons who will be staying in places where the Festival is being held. Therefore, any person staying in this area during the event is obliged to comply with the provisions of these Regulations.

The events taking place during the Festival are free except stage shows, entry tickets for the OFCA Campsite and entry tickets for OFCA Slackline. The tickets price list for stage shows can be found on the Festival website, i.e. www.festiwalofca.pl and at Infopoint. The ticket price list for the OFCA campsite and OFCA Slackline can be found on the Festival website, i.e. www.festiwalofca.pl and at the Festival Registration desk.

Tickets for stage shows will be sold in Infopoint during the Festival and before the start of the Festival through the websites indicated by the Organizer on the Festival website, i.e. www.festiwalofca.pl.

Entry tickets for the campsite and OFCA Slackline will only be available at the Festival Registration Desk during its opening hours. When purchasing entry tickets for the campsite and OFCA Slackline, the person purchasing the ticket should have and present an ID or passport upon request of the Organizer’s representatives.

Entry to stage shows is granted by tickets purchased during the Festival in Infopoint or purchased before the start of the Festival via the websites indicated by the Organiser on the Festival website, i.e. www.festiwalofca.pl, presented to the person carrying out the inspection at the entrance.

The Organizer establishes the minimum age limit for admission to each stage show as being at least 10 years of age. People with a valid ticket who have not reached the age required by the Organizer will not be admitted to the performances. In case of doubt, at the request of representatives of the Organizer, a school ID card or other document to prove the age of 10 must be presented. The Organizer is not obliged to refund any money for a ticket not used in such way. Information on the age of entry to individual performances is additionally announced in descriptions on the Festival website (www.festiwalofca.pl), the Event fanpage (www.facebook.com/festiwalofca) and printed materials distributed during the Festival, including on stage show tickets, as well as on websites through which tickets for performances can be purchased, as indicated by the Organizer on the Festival website.

Refunds of tickets/e-tickets are accepted only if the event is canceled. The Organizer will each time announce the possibilities and dates of refunding tickets/e-tickets on the website (www.festiwalofca.pl) and on the fanpage of the Event on Facebook (www.facebook.com/festiwalofca).

The Organizer is not obliged to refund money for unused tickets / e-tickets.

After purchasing an entry ticket for both the Campsite and Slacklines, participants of the Festival will be provided with a wristband in the appropriate colour, which entitles them to enter the Campsite or a Slackline (different colorus for participants of the Campsite and those using slacklines). The wristband must be put on the participant’s hand by the Organizer’s representatives. Every entry to the Campsite or Slackline tapes requires showing unbroken wristband fixed securely on the wrist.

Participants of the Festival and all other persons remaining at the venue are obliged to behave in a way that does not endanger the safety of other persons present at the Festival. It is forbidden to destroy equipment located on the Festival premises. Participants of the Festival and all other persons who are at its venue are obliged to follow the instructions of the Organizer and Security Service.

Festival’s Security Service or the Organizer may remove from the Festival venue those who disturb public order or behave contrary to the Regulations. Persons who have been denied access to the event or who have been removed from it are not entitled to any claims against the Organizer, in particular claims related to the refund of the ticket/e-ticket.

The Organizer may refuse to admit to the Festival:
a) person under the visible influence of alcohol, intoxicants, psychotropic drugs or other similar agents,
b) a person with weapons or other dangerous objects, explosives, pyrotechnic materials, fire hazardous materials, alcoholic beverages, intoxicants or psychotropic substances or other objects that in Organizer’s opinion may cause danger,
c) a person behaving aggressively, provocatively or otherwise posing a threat to security. -
The Organizer ensures safety and order to persons present at the Festival through, among others:
a) ensuring Security Service during the Festival in designated places, especially at the Campsite, 24/7
b) providing medical help points,
c) informing the Police and Fire Brigade about the Festival being organized and cooperation in ensuring safety. -
It is forbidden to conduct any commercial or other economic activity without the consent of the Organizer, as well as advertising and promotional activities at the venue of the Festival.

The Participant of the Festival is obliged to comply with the current (during the Festival) sanitary guidelines established by the state authorities.

The number of seats available in the audience during stage performances will depend on the currently applicable sanitary guidelines.

The Organizer is not liable for any damage or damage to health caused by the Participant or that may result from their participation in the Festival both toward the participant and third parties. This liability rests entirely with the Participant.

The Organizer of the event is not responsible for items left at the Festival by its Participants and other people remaining at the venue.

The Organizer is not liable for the effects of force majeure.

The Organizer reserves the right to cancel or shorten the Festival as well as implement changes to the program without prior notice, especially in case of weather breakdown or equipment failure.

In case of disputes, the ultimate decision is made by the Organizer, whose vote is final.

Participation in the Festival also includes consent for the participant’s image to be recorded, photographed or otherwise recorded and used for the purposes of posting on websites, social media, printed publications and other promotional and information materials of the Organisers, Partners and Sponsors of the Festival.

Participants of the Campsite and OFCA Slackline are also subject to other relevant Regulations, such as Campsite Regulations and OFCA Slackline Regulations.

INFORMATION CLAUSE
In accordance with Article 13 para. 1 and para. 2 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 /EC, we inform that:
1) The Administrator of your personal data is the Fundacja OFCA with its registered office at ul. Solarza 2B w Oleśnicy (postal code: 56-400), e-mail address: biuro@festiwalofca.pl.
2) Your personal data will be processed for the purpose of informing the public about the activities of the Fundacja OFCA, in particular by reproducing, capturing, and distributing the image, also together with images of other people, in the form of electronic media, including websites and social media.
3) The administrator will process identification data (e.g., image).
4) You have the right to access the content of the data and to rectify, erase or restrict processing, as well as the right to object, to request the cessation of processing and data transfer, the right to withdraw consent at any time and the right to file a complaint to the supervisory authority (i.e.: President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).
5) You have the right to withdraw your consent at any time without affecting the lawfulness of the processing performed on the basis of your consent before its revocation.
6) The recipients of your personal data may be social media operators. In addition, recipients of your data may be institutions authorized by law.
7) Your personal data will not be processed by in an automated manner including profiling.
8) The Administrator does not intend to transmit personal data to a third country or an international organization.
9) Personal data will be stored for the period necessary for the purpose of the processing, i.e. until your consent to distribute Your image is withdrawn, with effect at the end of the calendar month in which consent is being withdrawn. -

OFCA Campsite Regulations
OFCA Campsite Regulations
The Regulations, issued by the event’s organiser, i.e. the “Fundacja OFCA” with its registered office in Olesnica, ul. Solarza 2B, 56-400 Olesnica, KRS 559954, NIP 9112010907 (hereinafter: “Organiser”), is in force on the campsite organised for the “Olesnica Circus and Artistic Festival” (hereinafter: “Festival”), outside the walls of the Oleśnica Castle on 11-13.08.2023, hereinafter referred to as the Campsite.

The Campsite is open from 5:00 pm on Thursday, 10th August to 12 pm Monday, 14th August 2023.

The use of the Campsite costs 100 PLN. It is a fee per one person(hereinafter referred to as the Participant), for the whole time when the Campsite is organized. Children under the age of 10 are exempt from paying for using the campsite. The Organizer does not provide for any discounts related to shorter (than maximum available) stay of the Participant in the OFCA Campsite. It is also possible to purchase a combined admission ticket to the OFCA Campsite with OFCA Slackline for 250 PLN. It is possible to enter the campsite by camper. The fee for the vehicle is 200 PLN and does not exempt the owner from paying for the Campsite according to the price list above.

Participants under the age of 18 may participate in the Festival and use the Campsite on the basis of the consent of a legal guardian submitted during registration at the Festival Registration point.

Person under the age of 16 may participate in the Festival and use the Campsite only under the supervision of an adult who, at the first entrance to the Festival, signs the declaration of responsibility for the minor at the Festival Registration point.

Each person remaining at the Campsite must wear a wristband. The wristbands are obtained at the Registration point after paying a fee and signing a statement on getting acquainted with the Campsite Regulations. The wristband must be put on the Participant’s hand by the Organizer’s service.

The participant of the Campsite with a wristband may use showers and toilets located on the campsite free of charge.

Entrance to the area of the Campsite is only allowed for persons with wristbands and persons authorized by the Organizer.

Admission to the Campsite is forbidden to:
– persons who do not have the required wristbands nor the Organizer’s authorization,
– persons under the influence of alcohol and intoxicants,
– persons who have been denied access to the Campsite for safety reasons by a security guard.-
Campsite does not accept cars or motorcycles. The Campsite only accepts tents and campers.

Entering and staying at the Campsite means full acceptance of the Regulations.

At the entrance to the Campsite, the participants are obliged to show a wristband authorizing them to enter the Campsite.

At the Campsite it is prohibited to:
– make bonfires,
– have a barbecue,
– use open fire in tents,
– use gas cylinders,
– devastate infrastructure and interfere in any way in the surrounding greenery,
– disturb order,
– litter the area,
– bring in the items that may threaten safety of participants (e.g. firearms, firecrackers, knuckledusters, clubs, smoke candles, knives).
– bring in and consume alcohol, intoxicants and psychotropic substances,
– bring in animals (exception: dogs – obligatory on a leash, with a muzzle),
– conduct any commercial, advertising, acquisition and cash collection activities without the Organizer’s consent,
– satisfy physiological needs outside the toilets.-
It is forbidden to destroy and devastate the equipment at the Campsite and to dig holes and canals around the tents. In case of doing the above, the Participants are obliged to restore the initial state.

The Participant is obliged to comply with the current (during the Festival) sanitary guidelines established by the state authorities.

People who do not comply with the above mentioned Regulations will be expelled from the Campsite without any possibility of return.

The Organizer is not liable for lost or stolen valuable items.

The Participant is obliged to follow all instructions of the Organizer and security service.

The Organizer is not liable for damages and accidents of the Campsite Participants.

In case of disputes concerning issues not regulated by these Regulations, the decision is taken by the Organizer’s representative.

OFCA Slackline Regulations
“OFCA Slackline” Regulations
In order to ensure safety of participants of the event, we hereby introduce these Regulations (hereinafter referred to as: the “Regulations”), worded as follows:

The Regulations, issued by the Organiser, i.e. by the “Fundacja OFCA” with its registered office at ul. Solarza 2B, 56-400 Oleśnica, KRS 559954, NIP 9112010907 (hereinafter referred to as: the “Organiser”), refer to “OFCA Slackline”, which will take place from 11th to 13th August 2023 in Oleśnica as a part of “Oleśnica Festival of Circus and Art” (hereinafter referred to as: “Festival”).

Participation in the OFCA Slackline is only possible for adults with slackline experience (hereinafter referred to as the “Participant”). Minors are not allowed to participate in OFCA slackline.

Participation in OFCA Slackline is payable and amounts to PLN 250. This is a fee for one person for the entire festival. The ticket price includes free accommodation at the festival campsite and free entry to the Żongler bar throughout the entire Festival. The organizer does not provide any discounts related to participation in the event shorter than the maximum available.

Accepting the Regulations by the Participant and payment of a registration fee provide each Participant with unlimited access to all lines of OFCA Slackline: highline, waterline (if suspended).

OFCA Slackline participants are required to wear wristbands. The wristbands are issued at the Registration point after paying the fee and signing the statement on reading the OFCA Slackline Regulations and the Campsite Regulations. The band must be put on the User’s hand by the Organizer’s representatives.

The Organiser reserves the right to verify information declared by the Participant and, in case of providing false information, to prevent the person from participating in the OFCA Slackline. Furthermore, the Organiser may exclude the Participant from the OFCA Slackline if the Participant’s behaviour posed a threat to their or other persons’ safety or interfered with the course of the Festival.

Declaring their participation in the OFCA Slackline, the Participant bears full liability for injuries, material and non- material damage resulting from their participation in OFCA Slackline.

The Organiser is not liable for any damage or health impairment that may result from participation in the Festival, incurred in connection with participation in OFCA Slackline by both a participant and a third party. The participant is fully liable.

In case of disputes, a decision is taken by the Organiser, who has a casting and final vote.

The OFCA Slackline is held on the lines specially prepared and secured by designated and appropriately qualified persons with appropriate authorisation.

To step on the highline, the participant must have their own climbing harness. The harness must have appropriate certificates (CE for PPE, UIAA), as well as marks (manufacturer, date of manufacture, serial number). The above mentioned equipment must be in good working condition. If the equipment does not meet the specified requirements or its expiry date has expired, it may not be used. Full responsibility for equipment efficiency is borne by the Participant.

The Organiser reserves the right to verify the equipment i.e. it may carry out random inspections by a qualified person. An authorized person has the right to exclude equipment which does not meet the specified requirements.

The participant may only step on the highline in presence of an authorized person from the company dealing with works on heights. Access is possible after the Participant’s harness is checked by an authorized person. The authorized person checks technical condition of a highline itself, participant’s harness and a method of attaching the harness to the lunge.

The Participant may perform a manoeuvre of standing (e.g. ‘chongo start’) only at the designated place, i.e. behind the coloured tag on the line. The tag specifies a safe distance from the building structure. It is strictly forbidden to make a standing start from the structure of a building before such a marker. It is forbidden to use the façade of a building when entering back to the highline – the Participant must not touch the façade of the building. A manoeuvre of stepping onto a highline after previous fall may only take place with the aid of a lunge and the participant is expected to know this technique.

The Participant is recommended to wear appropriate protective clothing to the highline part (long trousers, gloves and a long-sleeved shirt). This is not mandatory, but performing without this clothing may lead to minor injuries (such as abrasions, bruises, cuts) for which the Participant is fully responsible.

The Participant is forbidden to wear or use any sharp or pointed objects that may cause partial or complete failure of the Participant’s safety equipment (any element of the highline system, lunge or harness of the Participant).

When stepping on a line, the Participant is forbidden to carry any items which could fall and pose risk to people and vehicles in the vicinity (e.g. a wallet, a phone, keys, etc.). Cameras or photo cameras must have their own lunge.

The only acceptable form of highline safety measure is harness with a lunge.

The Participants have the right to stay in highline areas only at officially designated hours and only under supervision of authorized persons. The Participants are strictly forbidden to make any changes to the line mounting systems. In case of a need for tightening of one of highlines or another technical improvement, it should be reported to the company dealing with works on heights.

The Participants may move in buildings intended for part of the highline only in designated places – marked with arrows. The Participants should use only marked emergency entrances. The Participants are strictly forbidden to enter unmarked rooms or to enter a line from unauthorized windows or passages. Any damage to the building interiors, façades or other elements of the building will result in removal from the festival and imposing a fine equal to the value of the damage.

The Participants use highline and waterline on their own responsibility and bear full liability for injury, material and non-material damage caused to themselves or others.

The Organiser is not responsible for the Participant who uses highline and waterline under influence of alcohol or other intoxicants.

Waterline Participants may use lines on their own responsibility, provided they are able to swim. The Organiser is not liable for safety of the Participants staying in the water.

The Festival participant is obliged to comply with the current (during the Festival) sanitary guidelines established by state authorities

Registered Participants thereby confirm that they are familiar with the provisions of these Regulations and accept them.

The Organiser is not liable for the equipment left at the Slackline town area or any other festival venue.
